Copyright and intellectual property policy

Notification of Copyright Infringement

Wonder Industries Limited and its subsidiaries (collectively, "Wonder Industries") respect the intellectual property rights of others and expects its users to do the same.

It is Wonder Industries' policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

In accordance with the Copyright, Designs and Patents Act of 1988, the text of which may be found on the United Kingdom Intellectual Property Office website, Wonder Industries will respond expeditiously to claims of copyright infringement committed using the Wonder Industries and/or Wonder Industries subsidiary or affiliated websites (the "Sites") that are reported to Wonder Industries, identified in the sample notice below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Sites by completing the following Notice of Alleged Infringement and delivering it to Wonder Industries. Upon receipt of the Notice as described below, Wonder Industries will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Sites.

Step 1: Identify the infringement
Make sure that you have clear evidence of the copyright infringement. You should have proof that you own the copyright, and evidence that someone else has been using your work without permission.

Step 2: Gather information
Identify the infringing party and collect their contact information, such as their name, email address, physical address, and phone number if possible. Also, locate the specific instances of infringement, such as website URLs or physical locations where the copyrighted material is being used.

Step 3: Start writing the notice
Your copyright infringement notice should include the following sections:

Date: Write the date at the top of the notice.
Your Information: Include your full name, address, and other contact information.
Infringer's Information: Write down the full name and address of the infringer, if known.
Description of the Copyrighted Work:
Provide a detailed description of your copyrighted work that has been infringed upon.
Evidence of Infringement: Detail where and how your work has been infringed. If the infringement is online, provide the exact URLs.
Statement of Good Faith: Include a statement that you believe in good faith that the use of the copyright materials described above has not been authorized by you or your agent, nor is such use made under any legal exemptions.
Your Signature: Write your full name at the end of the notice to act as your digital signature, followed by the date.

Step 4: Include the following legal statements
Make sure to include these legal statements:
1. A statement that you, as the complaining party, have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
2. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter Notices
One who has posted material that allegedly infringes a copyright may send Wonder Industries a counter-notice. When Wonder Industries receives a counter notice, Wonder Industries will reinstate the material in question in not less than 10 and not more than 14 business days after Wonder Industries receives the counter notice unless Wonder Industries first receives notice from the copyright claimant that he/she has filed a legal action to restrain the allegedly infringing activity. To provide a counter notice to Wonder Industries, please return the following form to Wonder Industries. Please note that if you provide a counter notice, in accordance with the Wonder Industries Privacy Policy, the counter notice will be given to the copyright claimant.

Step 1: Review the Infringement Notice
Read the notice thoroughly to ensure that you understand why you've been accused of copyright infringement. It's important to understand the specifics of the claim before you respond.

Step 2: Evaluate the Validity of the Claim
Check whether you have indeed violated the copyright, or if you believe the claim to be mistaken or due to a misunderstanding.

Step 3: Start Writing the Counter-Notice
Your counter-notice should include the following sections:

Date: Write the date at the top of the notice.
Your Information: Include your full name, address, and other contact information.
Claimant's Information: Write down the full name and address of the claimant.
Description of the Content and Its Location: Detail what work is in question and where it was posted. Include exact URLs if it's online content.
Reasons for Counter-Notice: State why you believe the notice to be mistaken. This can involve explaining how your use of the work is covered by fair use/fair dealing, the work is not under copyright, or you're not the infringer. Remember that it's often a good idea to get legal advice on this.
Statement of Good Faith: Include a statement that you have a good faith belief that the content was removed in error, and why. Make it clear that your counter-notice isn't meant to be taken lightly and that you understand the implications of submitting it.
Your Signature: Write your full name at the end of the notice to act as your digital signature, followed by the date.

Step 4: Include the following legal statements
Make sure to include these legal statements:

1. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
2. Your consent to the jurisdiction of a UK court in the district where you live (if you are in the UK), or your consent to the jurisdiction of a UK court if you are outside the UK.
